Over the 4-day weekend celebrating the birth of America, the Orange County Sheriff’s Department reported that 211 DUI arrests were made in Orange County, California. This is an increase from last year’s 108 DUI arrests over the July 4th weekend. Note that July 4th fell on a Sunday in 2010 and not everybody had a 4-day weekend.
The Orange County Sheriffs increased the number of deputies working that weekend specifically to arrest DUI drivers with the DUI Saturation Patrol. If you were arrested for driving under the influence, it is not an automatic conviction. There are a number of defenses that you may have.
Probable cause is an important factor that any July 4th DUI arrest should consider. The sheriffs were out specifically looking for DUI arrests and therefore may have been a little too enthusiastic about finding probably cause to pull someone over. Their supervisors would not be happy with their performance if they did not make a few DUI arrests, so as a DUI defense attorney, I would attack that bias. The officer’s overzealousness in making DUI arrests should be questioned. The police report, supplemental report, and personal notes should be closely examined to see if their story changes.
