July 4th is just around the corner.  This means there will be plenty of celebrations and plenty of drinking.  You can also expect an increased amount of cops working the weekend.  Be careful when you’re bar hopping, beach going, and beer running.

Naturally, this blog will discuss the crime of being drunk in public.  Public Intoxication is a crime classified as a misdemeanor.  A conviction can be punishable by up to six months in jail and thousands of dollars in fines and fees.

A minor (under 21) convicted of public intoxication can also lose his/her driver’s license even if driving wasn’t involved.  If the minor doesn’t have a driver’s license, the court can order the DMV to delay the issuance of a license for up to one year upon eligibility.

Being drunk in public, by itself, is not enough for a conviction of this crime.  The prosecutor must prove that as a result of you being drunk, you were unable to care for yourself or obstructed a public walkway.  The prosecutor must also prove you willfully drank alcohol.
