Defending a Civil Harassment Restraining Order

11 November 2011

In obtaining or defending yourself from a civil harassment restraining order, the burden is on the petitioner/plaintiff.  This is the person wanting the restraining order.  A respondent/defendant is the person the restraining order will be placed on if granted the by the court.

If granted, the restrained party must stay away, not contact, or disturb the petitioner in any way, whether directly or through a third party.

The petitioner must prove by clear and convincing evidence of either of the following:

  • An act of violence has been committed
  • A threat has been committed
  • A series of acts that would have annoyed a reasonable person done for no good reason
