DUI – Speeding Enhancement

A driving under the influence arrest can result in up to six months in county jail for a first time conviction.  If you were driving 20 miles per hour over the posted speed limit, your penalties can increase.

California Vehicle Code 23582 adds an additional 60 days in county jail if it can be proven that you were driving 20 miles per hour or more over the speed limit.  This increases the maximum jail time on a first time conviction of a DUI to 8 months in jail.
