Possessing Marijuana Pipes or Bong is Not Necessarily a Crime

Possession of drug paraphernalia can be a felony and is punishable by up to three years in state prison.  Drug paraphernalia can be any object that is used to inject or consume a drug.  Being in possession of it can be a crime even if there are no drugs around.

However, with the continuing shift towards legalizing marijuana, being in possession of any smoking instrument used to smoke marijuana may not necessarily be a crime.  Having a bong or marijuana pipe, by itself, is not enough to be convicted of possessing drug paraphernalia.  The prosecutors will also have to prove that there were some unlawful uses with the drug paraphernalia.  Having a medical marijuana card can also be a defense to this crime.
