DUI – Driving Under the Influence – California Vehicle Code 23152

California Vehicle Code 23152(b) – Driving Under the Influence with a BAC of 0.08% or Higher

There are several ways you can be charged with a DUI.  The most common way to get a DUI is by driving under the influence of alcohol and having a BAC (Blood Alcohol Concentration) of 0.08% or higher.  It does not take much alcohol to get to 0.08% BAC.

California Vehicle Code 23152(a) – Driving Under the Influence of Alcohol or Drugs

Even if your BAC is lower than 0.08%, you may still be charged with a DUI.  This occurs if the arresting officer determines that you are so impaired that you would not be able to drive a vehicle with the caution of a sober person.

Driving under the influence of drugs can also land you a DUI.  This type of DUI is also based on the arresting officers determination of your sobriety based on certain symptoms.  Your BAC is not needed with a Drug Dui charge.

Punishment:

The penalty for a DUI depends on whether a person has had any prior DUI convictions.  For a first time DUI, a conviction can result in jail time of 96 hours up to one year in county jail.  The court will also impose a heavy fine.  The driver’s driving privilege will also be suspended.
