Seeking Medical Assistance for Drug Overdose Defense

As of January 1, 2013, if a person is seeking medical assistance for a drug overdose in good faith, it is no longer a crime to be under the influence of, or to possess for personal use, a controlled substance or drug paraphernalia.

This new law allows anyone suffering from a drug overdose to seek medical assistance without the fear of prosecution of a drug crime.  The law does not apply to the sale of drugs.

The law also does not shield people from driving under the influence.

This law is a small step forward in the treatment of drug addiction as it promotes treatment rather than punishment.
