Disturbing the peace is a name for a crime that can be charged for several different reasons.  California Penal Code 415 defines the misdemeanor offense of disturbing the peace as the following:

  1. Any person who unlawfully fights in a public place or challenges another person in a public place to fight.
  2. Any person who maliciously and willfully disturbs another person by loud and unreasonable noise.
  3. Any person who uses offensive words in a public place which are inherently likely to provoke an immediate violent reaction.

PC 415 can be charged in situations where the police needs to arrest a crowd getting out of control.  This will most likely be one of the results on the Anaheim riots.

The punishment for a disturbing the peace conviction can result in up to 90 days in county jail, along with fines and fees to the court.
